Switching from temporary protection to a Spain residence permit

It depends: temporary protection (protección temporal) does not convert into a residence permit automatically — they are different legal statuses. Once your protection expires or is withdrawn, you need to apply on your own under one of the residence permit grounds: DNV, NLV, a student residence permit or family reunification. The choice of ground depends on your length of stay, source of income and family situation.

Why temporary protection ≠ residence permit

Protección temporal is an emergency humanitarian status: it grants the right to live and work, but it does not count as "residencia legal" in the full sense for most residence permit grounds. Time spent under temporary protection does not count towards permanent residence under the general rule. Plan your transition in advance — before the status expires.

There is also a legalization path through arraigo (a permit based on long-term ties, for those who have lived in Spain for several years without status) — our firm does not handle this route, so we do not cover it in detail here.

Step by step: what to do

  1. Choose your ground. Assess your income, length of stay and family situation — use the income calculator to check whether you meet the DNV or NLV thresholds.
  2. Gather your documents in advance. The criminal record certificate and medical certificate are valid for 90 days — order them closer to your filing date. Your full personalized list is in the checklist generator.
  3. Complete your empadronamiento (municipal address registration). Registration on the padrón is mandatory for most residence permit grounds — do it as early as possible, regardless of your current status.
  4. File your application before your temporary protection ends. If you file on time, you are entitled to stay in Spain while your application is being processed.
  5. Get your TIE card (the foreigner identity card). Once approved, you have 1 month to book a police appointment for your TIE card.
