When will I get permanent residence and Spanish citizenship?

How the time to Spanish citizenship is counted

The short answer: Spanish citizenship by residence (nacionalidad por residencia) is granted after 10 years of legal, continuous residence — this is the standard term, which applies to citizens of Russia, Ukraine, Belarus and Kazakhstan too. Reduced terms are set out in Article 22 of the Spanish Civil Code: 5 years for recognised refugees, 2 years for citizens of Ibero-American countries, Andorra, the Philippines, Equatorial Guinea, Portugal and Sephardic Jews, 1 year for those married to a Spanish citizen. On top of that term, allow 1–2 years for the application to be processed and for the oath.

The key phrase in the formula is "legal residence" (residencia legal). Only periods when you held a valid permit specifically for residence are counted: an ordinary residence permit, an EU-citizen family-member card, a refugee residence permit. Tourist trips, waiting for a decision and expired statuses do not count. Residence must be continuous and last up until the moment the application is filed.

Why student years don't count

Student status in Spain is legally called estancia por estudios — "stay for study", not "residence". So for citizenship student years do not count at all: the count of 10 (or 2) years begins from the date of your first real residence permit — for example, after switching from student status to a work residence permit. For permanent residence (residencia de larga duración) the rule is softer: under the current regulation (RD 1155/2024) study time counts by half — provided that at the time you apply for permanent residence you are already in residencia status. A student who studied for 4 years and switched to a residence permit brings 2 years of credit — and needs 3 more years instead of 5 to reach permanent residence.

Permanent residence and citizenship are two different statuses

Permanent residence (residencia de larga duración) is granted after 5 years of continuous legal residence and makes your status open-ended: you can live and work in Spain without being tied to your original ground. Citizenship is the next step: an EU passport, the right to vote, consular protection. Going through permanent residence before citizenship is not required — the qualifying period for citizenship accumulates from your first residence permit, whether or not you obtained permanent residence or keep renewing temporary cards. The spouse of a Spanish citizen can apply for citizenship after just 1 year of legal residence — earlier than they would obtain permanent residence.

What breaks the continuity of residence

For permanent residence the absence limits are set out in the regulation: no more than 6 consecutive months outside Spain and no more than 10 months in total over 5 years (up to 18 months if the trips were work-related). For citizenship the law does not name an exact figure — the Supreme Court assesses whether your "centre of life" remains in Spain: housing, work, family, taxes, the children's school. Practical guidelines from Ministry of Justice practice: over the 10-year term, absences longer than 6 consecutive months are risky; under the reduced 1–2-year terms the bar is held tighter — around 3 months a year. Many short trips can also count against the applicant if, taken together, they show you don't actually live in Spain.

Exams and renouncing your previous citizenship

Two Instituto Cervantes certificates are attached to the application: the language exam DELE A2 (or higher) and the country-knowledge exam CCSE. Citizens of countries where Spanish is the official language are exempt from DELE; minors take neither. A separate issue is renouncing your previous citizenship: Article 23 of the Civil Code requires a declaration of renunciation at the oath (this does not apply to Ibero-Americans and citizens of a few other countries). It's important to be honest about this: it is a formal declaration in the Spanish Registro Civil. Spain does not require a certificate of actual renunciation and does not verify it. Under Russian law, citizenship ends only through its own renunciation procedure — so the declaration by itself does not strip you of a Russian passport, but for the Spanish state from that moment you are only Spanish. The legal consequences for your specific situation should be discussed with a lawyer in detail.

Timeframes after filing

A citizenship application is processed on average in 1–2 years (the official maximum term is one year, but the queue is real). After approval you have 180 days to take the oath, then the DNI and passport are issued. In total, the real path for a Russian with an ordinary residence permit: 5 years to permanent residence → 10 years to filing for citizenship → roughly 11–12 years to a passport. For Spain, however, from that point you are only a Spanish citizen.

For permanent residence: no more than 6 consecutive months and 10 months in total over 5 years (18 for work-related reasons). For citizenship there is no fixed figure — the centre of life is assessed; a practical guideline over the 10-year term is not to be away for more than 6 consecutive months, and under reduced terms to stay within about 3 months a year.

Which exams are required for Spanish citizenship?
