Can a foreigner buy contribution years in Spain?

It depends on what “buying” means here. A foreigner with a valid residence permit and NIE (foreigner identification number) can pay voluntary contributions into Seguridad Social (the Spanish social security system) — this builds up a pension contribution record. However, Spanish law does not provide for “buying back” past years when you were outside the Spanish system: only periods with actual contributions count.
What voluntary contributions are (convenio especial)
A convenio especial is an agreement with Seguridad Social under which a person pays contributions on their own, without being employed. It is relevant for:
- holders of the NLV (a residence permit without the right to work) who want to build up a record toward a future pension;
- entrepreneurs and freelancers temporarily pausing their activity;
- those who have obtained permanent residence and plan to retire on a Spanish pension.
The contribution amount is calculated at the official Seguridad Social rate (check the TGSS website — it depends on the base elegida, your chosen contribution base).

Step by step: how to start building your record voluntarily

- Check your accumulated record. Request an informe de vida laboral (employment history report) from Seguridad Social online (via sede.seg-social.gob.es) or at a TGSS office. For the minimum threshold for the convenio especial, check the current rules with the TGSS.
- Apply for the convenio especial. Form TA-0040 + residence permit documents + NIE. Approval takes from a few weeks to a month.
- Pay contributions monthly. The amount depends on your chosen contribution base (base de cotización). The higher the base, the higher your future pension.
- Track your record. Request an updated vida laboral every year to make sure your periods are recorded correctly.
What does not work: common misconceptions
- “Buying” 10 years with a single payment — impossible. Spanish law does not allow a one-off purchase of retroactive periods.
- “Russian work history cannot be credited” — a common misconception: the bilateral Spain–Russia Social Security Agreement was signed on 11.04.1994 and has been in force since 22.02.1996 (BOE 24.02.1996). Crediting (totalización) is arranged by applying to the INSS with confirmation of your record from Russia's Social Fund (SFR); today's difficulty is practical: obtaining and legalising supporting documents from Russia has become slower and harder.
- Getting a Spanish pension with no minimum record — a contributory pension requires a minimum threshold of contributions (check the official Seguridad Social rules).
