First Spain residence permit: 1 year or 3 years?

Updated: 22 August 2026 · Verified against official sources

It depends: there is no single period — the first residence card is issued either for one year or for a three-year term straight away, and the grounds decide it. Digital nomad status more often results in three years, the non-lucrative residence and study routes — one year, while with family reunification the card is aligned with the sponsor's status.

Why the term differs

Each ground is governed by its own legal provision, and the validity period is set out precisely there. One more nuance: the application route. If you start from Russia through the consulate, you first receive a national type D visa for one year — that is your first legal period of residence. You obtain the residence card once already in Spain, and it may cover the next three-year stretch. If, however, the documents go directly to the Spanish authority (UGE), the permit is often granted for three years right away. More about the routes in our guide how to obtain resident status.

Keep the expiry dates in mind well in advance: the window to apply for the next period opens before the current one runs out — the timelines and procedure are covered on the residence renewal.

What to do after approval: step by step

  1. Enter Spain on the type D visa — the clock starts from the date you cross the border.
  2. Book your fingerprinting appointment (toma de huellas): the window to submit the card application is 1 month after entry.
  3. Pay the fee using form 790-012 — issuing the card costs 16 €.
  4. Collect the physical card: production takes 30–45 days. The date on the card is your real deadline.
  5. Count your accumulated years: eligibility for permanent residence arises after 5 years of continuous residence.

Not sure which grounds would suit you and what period you would end up with? Check your numbers in the income calculator — it will show whether you meet the thresholds, and the checklist generator will assemble the document package for your case.

What the term does not affect

A one-year card is not "worse" than a three-year one in terms of rights: travel within Schengen, access to banking services, school for children and healthcare work the same. The difference lies in how often you visit the immigration office and how much proof you provide at each renewal. Meanwhile, continuity of residence counts the same way: both one year and three years go towards the total required for permanent residence, as long as you do not stay out of the country for too long.
